Terms & Conditions of Supply

Please read these terms and conditions carefully before submitting your sell order from our site. You should understand that by submitting an order, you agree to be bound by these terms and conditions and our terms of use.

You should print and keep a copy of these terms and conditions and the terms of use for future reference.

In confirming your sell order you will need to tick the box indicating that you accept these terms and conditions. Please understand that if you refuse to accept these terms and conditions, you will not be able to place a sell order via our site.

Copyright

All information and content available on the Site, including but not limited to logos, texts, button icons, graphics, data compilation, images, audio clips thereof (collectively the "Site Content"), is the property of GSMNET Ltd and protected by all laws, including laws governing copyright and other intellectual property rights.

Unless otherwise expressly authorized by law, you may not use, transfer or copy any of the Site Contents for public or commercial use without our permission, and you may print out the Site Content, download extracts or any pages for your personal use only. Our status as the owner of the Site Content shall always be acknowledged.

How The Contract Is Formed Between You And Us

Our site is only intended for use by people registered with us and resident in Great Britain. At our complete discretion we may accept or reject orders from people outside of these territories.

Your contract with us will be formed when we receive your sell order. It will incorporate these terms and conditions and our terms of use. Please click on the "How It Works" page for more information.

You must own all rights, title and interests in any phone(s) that you send to us.

Ownership of the phone(s) will pass to us when we receive the phones, in accordance with these terms and conditions, and we have dispatched payment to you, when, hence, a contract will be formed.

The contract between you and us is binding on you and us and on our respective successors and assigns.

You may not transfer, assign, charge or otherwise dispose of a contract, or any of your rights or obligations arising under it, without our prior written consent.

We may transfer, assign, charge, sub-contract or otherwise dispose of a contract, or any of our rights or obligations arising under it, at any time during the term of the contract.

Before placing your order, please be aware that Sell Phones charge a £10 fee for order cancellations or returns. Your sell order will expire within 14 days starting from the day the sell order was created.

When cancelling during the cooling-off period, you need to give us a reason for cancelling the contract.

To cancel the contract you must notify us in writing.

Other than if the phone does not meet our terms and conditions (see below), this contract cannot be cancelled after you have sent your phone(s) to us (outside the "cooling-off period").

PLEASE ENSURE THAT YOU ARE HAPPY TO SEND THE PHONE TO US AND THAT IT IS WITHIN YOUR RIGHTS TO DO SO.

Consumers

By placing an order through our site, you warrant that:

  • You are resident in Great Britain;
  • You are accessing our site from that country;
  • You are legally capable of entering into a binding contract;
  • You are at least 18 years old; or
  • If you are under 18 years of age, that you have obtained your parent's or guardian's consent to sell your phone to us for the sum indicated via our website.

You and your parents or guardians release us of any liabilities or claims that may arise if you send the phone to us in breach of this warranty.

If you deal as a consumer any provision of this contract which is of no effect to a consumer shall not apply. Your statutory rights are not affected by this contract.

For the purposes of these terms and conditions, "consumer" means an individual who neither makes this contract in the course of a business, nor holds himself out as doing so, as defined by the Unfair Contract Terms Act 1977.

Businesses

By placing an order through our site, you warrant that:

  • You are authorised to act on behalf of the registered business; and
  • You are based in Great Britain; and
  • You are accessing our site from that country; and
  • You are legally capable of entering into a binding contract.

Phones and Devices

copy of your ID e.g. Passport or Driving License is required for all brand new and expensive used phones above £200. 

Each mobile phone or device sold should match the make and model in the sale order and meet the following conditions:

New:

• Box must be factory sealed and the device brand new, never used

• All accessories are present and unopened

• IMEI on the box matches that on the phone

• Original retail box is in a good condition, not a generic/white box

• Device should not be at any case a refurbished or a reconditioned one

 

New Other:

• Device must be unused

• Factory screen seal presents and not resealed

• It may be a manufacturer refurbished/replacement item

• There are absolutely no marks or scratches on the phone

• Original box and accessories can be missing 

 

Good:

• Device is fully functional

• Acceptable light wear and tear

• Touch, Face ID, NFC fully working (If applicable)

• No damage (e.g. water damage, dead pixels, screen/body chips or cracks)

 

Fair: 

• Device is fully functional

• Acceptable light wear and tear

• Touch, Face ID, NFC fully working (If applicable)

• No damage (e.g. water damage, dead pixels, screen/body chips or cracks)

 

In the case of a device being reported as network blocked AFTER your device has been recycled

and we have made payment to you, we will report it to the Police and start legal action.

 

Broken:

• Faulty screen or housing or rear glass (cracks, discolouration, dead spots/pixels, pressure marks)

• Device freezes, crashes regularly, isn’t charging or won’t connect to a pc

• Major software/hardware issues e.g.

• Device sensors are not working (e.g. proximity, accelerometer, GPS)

• Dust under screen and/or under camera

• Significant physical damage and/or water damage

• Device must not have missing components or be bent, crushed or snapped in half.

• Touch, Face ID malfunction or water damage will lead to a reduction of price

 If your device is severely damaged internally, unfortunatelly we won't be able to pay the full price quoted. If your device doesn't match the initially offered price we will email you with a new quote. 

 

All phones and devices must be on a UK network or not locked. Phones or devices locked to a foreign network will not be accepted.

By submitting an order through our site you warrant that the phone(s) comply with these terms.

Once you have posted a phone to GSMNET, it will not be possible to return it or any accessories for any reason so please make sure really want to send it to us.

If a phone fails to meet our terms and conditions we'll propose an adjusted price by email. If you choose to decline our new offer, we are happy to return the phone. We have the final decision on all phone values. Adjusted orders will be automatically processed for payment if you do not reply to our proposed offer email within 7 days.

Please note:

  • You are responsible for cancelling any airtime contract linked to each handset. We are not responsible for any call costs arising before, or after, receipt of your handset, or arising from any other circumstances whatsoever.
  • Please ensure you remove your SIM card before sending us your mobile phone. We accept no liability in the event that a SIM card is sent with a phone and charges are then incurred. You shall continue to be responsible for such charges. Any SIM cards received by us are non-returnable.
  • Please remember that by sending your phone to us, you agree to release us from all and any claims, losses or damages with respect to the phone, any data stored or contained therein or on any media used in conjunction with the phone (whether in the form of personal details, SMS, photos, games, songs or other data ("Data")). We accept no responsibility in relation to the security, protection, confidentiality or use of such data and it is your responsibility to ensure that such data is removed from the phone prior to you sending it to us.

Return Policy

In case of a revised offer being offered for your mobile phone(s) and you are not happy to accept, we are happy to return the mobile phone(s) back to you through Royal Mail recorded delivery free of charge. 

Royal Mail Recorded Delivery - free. Provides a tracking number and a compensation of up to £50.00 in case of any loss or damage to the post. Please note, GSMNET does not accept any responsibility for non-delivery/loss or damage of mobile phone(s) being returned back to customer and will not offer any additional compensation apart from what Royal Mail provides.

Royal Mail Special Delivery - £10.00. Provides a tracking number and a compensation of up to £500.00 in case of any loss or damage to the post.

Policy of Lost or Stolen and Counterfeit Phones or non UK specs phones

    If we find upon inspection of devices that you have sold that they have been registered or reported lost, stolen, blocked or barred, or we believe the device you have sent to us could be counterfeit we will notify you by email and quarantine the device whilst we contact the relevant authorities.

    We check every device received against the National CheckMEND Register (the “Register”). The Register identifies phones that have been lost, stolen, blocked or barred with a ‘red flag’.

    If your device is found to have a 'red flag' against it, you will have 28 days to contact CheckMEND (the “Quarantine Period”), who will provide advice on how to prove that you are the legal owner of the device.

    You can begin the process by visiting the CheckMEND website at http://www.checkmend.com/uk/.  You will be asked to provide a brief description of the issue, as well as your certificate ID number which we will provide you with in our notification email.

    We cannot send your device back to you or make any payments during this period, and are legally required to dispose of the device if the ‘red flag’ against your device is not lifted within the Quarantine Period.

    We do not accept non UK specification devices.

    We accept no liability or responsibility for rejecting your Item or not returning your Item to you in these circumstances.

Pricing

All prices indicated on our website include VAT (where applicable) at current rate. Prices offered on our website are subject to change at any time without notice.

When your order has been placed, the prices quoted are guaranteed for 14 days from the 'Order Approved' date. (This is the date on which we send you a confirmation letter.) If your phones are received after 14 days from the 'Order Approved' date, the up-dated, current prices will apply. This could be disappointing - so to help you, we'll send a reminder email during the 14 day guarantee period.

We reserve the right to make revised offers on any phone received which is different in model or working / non-working condition as described on our website. These offers are made by email after the phones are processed and need to be accepted within seven days by email reply. If we do not receive your email reply of our revised offers within 7 days, revised offers will be automatically proceeded to payment. We will not be held liable if any payment is delayed because of no response received from the customer.

We reserve the right to cancel any order where we see appropriate. 

For customers, who send in more then two devices revised offers will be made on the sale as a whole. We will use our reasonable endeavors to provide our customers with the 'Best Price' for their mobile phones. However, this is not a guarantee. We shall not be held liable under any circumstances regarding price pledges. 

Postage & Packaging

Phones and devices must be packaged in accordance with our packaging instructions to ensure safe and successful delivery to us.

We do not accept responsibility for non-delivery of phones or damage in transit. We therefore recommend that you send any high value units via registered post to ensure successful delivery.

Bank Transfer Payments

We offer an option of bank transfer payment.

Bank Transfer payments can only be made to the account details given when placing the online order. We cannot, under any circumstances, recall or reissue bank transfer payments once they have been made.

Events Outside Of Our Control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control or due to our compliance with any applicable laws or regulations.

How Do I Ship My Item?
Simply package up your item using your own packaging. Then attach our shipping label with clear tape. You can drop off your package at any Post Office. It is recommended to ship your device using Royal Mail Special Delivery.
How Long Does It Take To Get Paid?
Your payment is issued as soon your item(s) are received and inspected, usually within 1 working day of our receipt of your item(s).
What If My Apple Device is Activation Locked?
